Can I apply for a loan if I am unemployed due to my injury?

Yes. Unlike traditional lenders, we recognise that you will receive a future entitlement which we lend against; no repayment is due until settlement.

Can I apply for more than one loan?

Yes. As your matter progresses ASK will be able to better determine what the final outcome will be – and we will look at providing further credit. You can reapply for an additional loan three months after your initial loan has been approved.

Can I apply if I have been declared bankrupt in the past?

Yes. But you need to be discharged.

Can I draw funds down as required or does it need to be drawn down in a lump sum?*

Upon approval ASK will establish a facility for you – similar to a personal overdraft – where funds are paid on request to your Solicitor's Trust Account in order to satisfy invoices that have been previously rendered. Since interest only accrues on funds that have been drawn, having fees paid on an ‘as needs basis’ provides a significant cost saving to you.
*This applies to Family Law and Estate Loans only.

Do you take a percentage of my winnings?

No. We simply charge an annual interest based on the risk associated with lending. Please be aware that an administration fee will be charged all loans. The fee is calculated on the amount of the loan and will be deducted from your overall approved loan amount.

How come it takes so long to approve my loan?

Our process is a little more complicated than a typical bank, as we need to receive legal documentation from your solicitor and then review your case details with our own legal team. Unfortunately delays can be experienced due to the time it takes to receive all the necessary paperwork from your solicitor which is required for reviewing your case details. 


How do I pay back my loan?

No payments are required until the settlement of your case. At which time your solicitor will be able to help you with this process when your settlement has come through. However we advise that you make cheques payable to Ask Funding Limited and post them to Po Box 7111 Riverside Centre Qld 4001. Please note that we don't accept electronic fund transfers into our bank account


How do I qualify for an ASK Loan?

You must be represented by a lawyer and have a current legal case. Assessment criteria apply.

How does the Injury Loan process work?

Step 1 - You need to complete the application form. We will send you an SMS to confirm receipt of the application.

Step 2 - We then send your solicitor a Request for Information document. This will provide us details of your case. Once we have received and reviewed this information then we can proceed with loan assessment.

Step 3 - Loan assessment takes about 72 hours from the time we have all your paperwork from the solicitor.

Step 4 - We then approve your loan and send you and SMS to advise you that the loan is approved and the amount it is approved for.

Step 5 - To confirm the loan, we will send you loan documents to be signed by you; we will also send your solicitor a document called the 'Irrevocable Instruction' Confirmation of receipt and acceptance must be signed by your solicitor and received by us before we can transfer your funds.

Step 6 - Once we have received all documents, allow two business days for the transfer.


How long does it take for the money to come through?

Once all the documents are received we can usually complete the assessment and approval process within 72 hours. Upon loan approval, we prepare and forward the loan deed for you to sign and post back. Funds can be transferred within 2 business days upon receipt of the fully-completed contract.

How much can I borrow?

ASK lends from $2,000. The amount you can borrow will be assessed against your future entitlement and we will then lend a percentage of that amount.

How will I know if my application has been approved?

You will receive an SMS to advise that your loan has been approved, and for how much.

How will I know when my money has gone through to my account?

Personal Injury:

You will receive an SMS the day that the payment is processed.

Family Law:

If you have been approved for living expenses you will receive an SMS the day that the payment is processed and the money will be transferred into your nominated bank account.

Legal fees and disbursements are paid directly to your solicitor’s Trust Account. Please note the solicitor cannot draw against your facility without your prior written approval.

My loan has been approved, but the money has not been deposited into my account, what is the delay?

Once your loan has been approved, we need to receive the loan documents signed from you, plus the irrevocable instruction signed from your solicitor. Once this has been received, funds will be transferred within two business days.


My solicitor said I could get much more than I have been approved for, why is my loan amount less than what they said?

Our process requires that each application is reviewed on a case by case basis and unfortunately, your solicitor was not in a position to advise you how much your loan would be approved for.  As your matter progresses we will be able to better determine what the final outcome will be – and we will look at providing further credit. Please note you need to wait three months after your initial loan to reapply.


What happens if I lose my case?

If you settle with insufficient funds to repay ASK and your matter has been properly prosecuted and no fraud has been involved, we will not chase you for any money*

What information do you require from me?

You need to complete an application form, which you can download directly from this website. Once we receive your application we will contact your solicitor in writing, asking a few questions in relation to your legal case.

What is your assessment criteria?

Personal Injury:

If you have a Work Cover Claim or have been involved in a Motor Vehicle Accident your matter must have advanced to a stage where liabilities are admitted or not an issue (e.g. being a passenger in a car accident and clearly not being at fault). The reason for this is that we need to be able to determine a future entitlement to enable us to lend against your claim. Please note in the state of NSW we cannot lend against Work Cover Claims as we are unable to take a lien over the settlement proceeds.

Family Law:

In Family Law you can apply at any stage, but you must have a minimum equity of $400,000.00 in real property to enable us to lend.

Estate Litigation

Probate must be granted in Estate Litigation for us to advance funding.

What security do you require?*

Personal Injury:

This is an unsecured loan, meaning we will not take a lien over your personal assets or property. You simply just sign an irrevocable instruction whereby you instruct your solicitor to pay ASK the principle amount plus interest out of your settlement proceeds.

Family Law and Estate Litigation

Usually real security by way of equitable mortgage supported by a caveat or in some cases a registered mortgage.

When do I have to make repayments?

No repayments are required until your case is settled. You can, however, make repayments at any time throughout the loan period if you choose to.
